General Terms and Conditions
1. General Information
1.1. Tourismus Salzburg GmbH (hereinafter referred to as: TSG) operates an Internet portal under the website www.salzburg.info/bus, which is intended to regulate tourism bus traffic in the City of Salzburg. Pursuant to a resolution passed by the Salzburg City Council on 7.2.2018, the delivery and pick-up of guests for the purpose of visits, guided tours etc. in the inner-city is now only possible on a restricted basis and at the terminals designated for such a purpose.
1.2. Using the booking portal for bus companies (hereinafter referred to as: Participant) which is integrated into its website www.salzburg.info/bus, TSG provides the opportunity to purchase access permits in order to drop off or pick up guests wishing to visit or tour the city.
2. Legal Scope
2.1. These General Terms & Conditions apply to all contracts between TSG and Participants, which are entered into by means of the booking portal operated by TSG on the website www.salzburg.info/bus.
2.2. Contradictory general terms and conditions of the Participant have no application.
2.3. By purchasing an access permit/voucher on the website www.salzburg.info/bus, the Participant agrees to these General Terms & Conditions without restriction.
3. Registration and Ordering Process
3.1. The booking portal on the website www.salzburg.info/bus does not represent a binding offer for conclusion of a sales contract, but rather gives the Participant a nonbinding opportunity to purchase an access permit/voucher.
3.2. In order to use the booking portal on the website www.salzburg.info/bus, the Participant’s one-time registration in the system is required. The Participant guarantees that the data he provides, in particular that which applies to his commercial and independent activities, is complete and accurate.
3.3. Upon completing registration, TSG offers the Participant the opportunity to use the customer portal in order to make and view bookings, changes, cancellations etc. The individual technical steps required are clearly laid out within the booking portal and easy to understand. The booking process is divided into provision of information by the Participant, the assignment of timeslots and parking, the opportunity to double-check the shopping basket, as well as completion of payment.
3.4. On the basis of the information provided by the Participant (including arrival day, arrival time, pick-up time, etc.), as well as the utilization rate of the available terminals and concrete timeslots, a parking area will be suggested. On an optional basis and based on availability, the Participant may make a different selection.
3.5. The selected timeslot and parking area is added to the shopping basket. Using the appropriate button in the navigation menu, the Participant may open the shopping basket and make any changes that might be necessary. At the same time as checking his information, the Participant also has the opportunity to provide the email address and mobile phone number of the bus driver.
Upon opening the page “pay now”, the Participant will again be shown the products which have been selected, the email address which has been provided, as well as total costs including the applicable sales tax. The Participant will then be asked to provide payment details. Payment is possible only by credit card using the payment provider “Data Trans”. The Participant is automatically redirected to a secure payment form operated by the payment provider, which means that supplemental terms of business of said payment provider may apply, and upon which TSG has no influence whatsoever.
By submitting the order using the appropriate button, the Participant is making a binding offer for the monetary purchase of the products which are in the “shopping basket”.
3.6. As soon as TSG has received a confirmation from the payment provider that the payment has been completed successfully, an invoice, an access permit (see point 4.1.) for the terminal as well as an access voucher (see point 4.2.) for the bus parking area will be sent to the email address which was provided during the registration process as well as to the email address of the bus driver, if provided.
3.7. After completing the ordering process, changes to the arrival and pick-up times are only possible on a limited basis and subject to availability/demand, and by no later than 5 PM of the day before by means of the customer portal. A reduction of the number of booked timeslots is possible at any time, though any payments which have been received will automatically be forfeited if notification is provided less than two weeks prior to scheduled arrival. An increase in the number of timeslots is no longer possible at a later date and requires a new booking process. In general, subsequent changes to date and choice of terminal are not possible.
4. Access Permits/Vouchers
4.1. The access permit for the terminal contains a QR code, GPS coordinates of the terminal in question, the address of this terminal as well as a code number, validity date as well as details of the drop-off and pick-up timeslots. It entitles the Participant to use the allocated terminal in order to drop off and pick up guests who will be visiting, touring the city etc.
4.2. The access voucher for the parking area contains a QR code, GPS coordinates of the parking area in question, the address of this parking area as well as usage regulations in the form of a text. It entitles the Participant to use the parking area which has been assigned.
4.3. Upon pulling into the allocated terminal, the Participant or bus driver must present the access permit, which on-site staff will then verify by scanning the QR code. It is possible to arrive at the terminal outside of the allocated time slot if the bus is delayed; In order to avoid disruption to operations, however, the bus may be required to wait in line depending on how busy the terminal is.
Arrival at the terminal without a valid access permit is not permissible and may result in staff seeking an official remedy.
4.4. Upon arrival at the allocated parking area, the Participant/bus driver must present the access voucher and exchange it for a standard parking ticket. In accordance with the usage rights which have been purchased, the bus may enter and leave the allocated parking area on multiple occasions.
5. Prices and Retention of Ownership
5.1. All of the prices which are listed on the website www.salzburg.info/bus include statutory sales taxes.
5.2. Until payment has been received in full, all goods remain the property of TSG.
6. Warrantee and Compensation
6.1. In accordance with §377 of the Austrian Commercial Code, the Participant must inspect the purchased products for deficiencies and report any deficiencies as may be discovered without delay.
6.2. TSG is only liable for damages insofar as these can be proven to be the result of premeditated or gross negligence, and to the extent of statutory requirements; this does not apply to damages associated with injury to life, limb or health. Liability for indirect damages, lost earnings or positive breach of contract is expressly excluded.
7. Data Protection
7.1. TSG has established appropriate electronic and administrative measures in order to protect personally identifiable information and to avoid unauthorized access as well as unauthorized disclosure of such data.
7.2. TSG will use the personally identifiable data which you have provided exclusively in order to provide stipulated services and will not share said data with third parties. Provision of personally identifiable data is subject to the provisions of our full privacy declaration.
8. Concluding Provisions
8.1. Should individual provisions of these general terms and conditions be declared null or avoid, this in no way affects the remaining provisions.
8.2. Austrian law shall apply under the exclusion of the UN Convention on Contracts for the International Sale of Goods as well as of referring statutes of international private law.
8.3. Seat of jurisdiction for any and all disputes as may arise is the materially competent court within the City of Salzburg.
